New Cases Alert | Consumer Protection and Privacy Investigations

Peiffer Wolf is investigating MOSH, PDP, and companies advertising “Nootropic” food products for alleged false advertisement. We are also investigating StubHub, Curiosity Stream, and Entrepreneur.com for various consumer and privacy violations.

If you purchased products or subscriptions from these companies, contact us for a Free Consultation by filling out an online contact form or by calling 314-669-3600.

PDP Game Controllers | False Advertising Investigation

PDP is a licensed third-party manufacturer for popular gaming consoles including Xbox, Nintendo Switch, PlayStation. It advertises a wide range of products, including controllers, headsets, keyboards, and more.

Our investigation has led us to believe that PDP falsely advertised its products’ ability to link with gaming consoles’ immersive motion control features, which is a key function of playing games such as Mario Kart, Mario Party, Arms, Splatoon 2, etc.

Motion Control, according to PDP advertising, allows a player to “enhance [one’s] play for motion sensing games like Mario Kart 8, Mario Party, Arms, Splatoon 2, Zelda Breath of the Wild and Doom.”

PDP claims their gaming controllers support Motion Control – however, our investigation has led us to believe that a number of PDP Controllers do not support Motion Control.

If you purchased a PDP Controller that advertised motion control, contact us for a Free Consultation by filling out an online contact form or by calling 314-669-3600.

Nootropic Food Products | False Advertising Investigation

Peiffer Wolf believes that companies advertising “Nootropic” food products that provide a “mental boost” or “cognitive benefits” are allegedly misleading consumers. Products included in our investigation include (but are not limited to):

  • MOSH Protein Bars
  • Moment Drinks
  • Nerd Focus Energy Drinks
  • CENTR Enhanced Drinks
  • Odyssey Mushroom Elixir
  • Kin Euphorics Drinks

If you or a member of your household purchased any Nootropic food or drink product that claimed to provide a “mental boost” or “cognitive benefits”, contact us for a Free Consultation by filling out an online contact form or by calling 314-669-3600.

Curiosity Stream and Entrepreneur.com  | VPPA Claims

Peiffer Wolf is currently investigating Curiosity Stream and Entrepeneur.com Video Privacy claims. Our investigations have led us to believe that these companies may have violated a federal law called the Video Privacy Protection Act.

The Video Privacy Protection Act Amendments Act of 2012 specifically clarified that “a video tape service provider may obtain a consumer’s informed, written consent on an ongoing basis and that consent may be obtained through the Internet.”

Curiosity Stream and Entrepreneur.com allegedly tracked video content viewed by subscribers and then shared their private and sensitive data with Facebook and parent company Meta.

If you have an active CuriosityStream or Entrepreneur.com subscription (or had one within the past two years) and accessed it through your web browser, contact us for a Free Consultation by filling out an online contact form or by calling 314-669-3600.

StubHub Hidden Fees Investigation

StubHub allegedly hid some ticket fees on its platforms, only showing the real total amount when consumers had already proceeded to finalize the purchase. Disclosing fees upfront ensures transparency and fairness in transactions.

If you purchased tickets through StubHub and were shown some, but not all of the fees until the end of the purchasing process, contact us for a Free Consultation by filling out an online contact form or by calling 314-669-3600.

Yes. Please call us or use our contact form to request a Free Case Evaluation. We have a national team of attorneys and staff who look forward to speaking with you.

Typically, we represent clients on contingency fee agreements. If we take your case under a contingency fee arrangement, you won’t owe our firm any legal fees unless we are able to recover money for you.

Our contingency fee agreements are usually based on a percentage of the amount we recover for our clients. The contingency fee amount is determined by the type of case, our estimate of how long it will take to resolve your case, and our estimate of the litigation costs we will advance in your case. Each engagement agreement includes the details of the fee arrangement. Questions about our fee agreements are welcomed and encouraged.

In most litigation matters, it is extremely difficult – practically impossible – to predict how long it will take to resolve a particular case. Every case is different, and we will do our best to provide you with an estimate based on your case and our experience with similar cases. Moreover, we will do our best to keep you updated and manage expectations along the way.
