CooperSurgical IVF Media Recall | Embryo Destruction Lawsuits

“My law firm has represented hundreds of families and individuals who have had their hopes and dreams dashed by the outrageous conduct of the U.S. fertility industry.” (Peiffer Wolf Partner Adam Wolf)

In December 2023, CooperSurgical sent a recall notice to Fertility Clinics, IVF Clinics, and Fertility Doctors after many reports of failure to develop embryos in contact with specific lots of its embryo solution (LifeGlobal global® Media).

Aspire Houston Fertility Institute, according to a lawsuit, is one of the Fertility Clinics that used CooperSurgical’s recalled embryo culture media, which resulted in non-viable embryos that were allegedly still used in IVF treatments that were unsuccessful and, in some cases, resulted in miscarriages.

The alleged use of embryos that were impacted by the recalled embryo culture media by CooperSurgical should have never happened. Still, according to Axios, patients say Aspire clinicians “knowingly implanted dying and dead embryos.”

Peiffer Wolf has filed multiple lawsuits on behalf of couples whose embryos were destroyed by CooperSurgical’s embryo culture, and we are now investigating victims of Fertility Clinics that used the recalled product and never properly discarded the non-viable embryos, causing patients to go through a very delicate procedure that was already set to fail.

“Keep in mind that these families have entrusted their most valuable property in the entire world – their embryos – to these facilities and clinics. We want to make sure that these devastating tragedies never happen again.”  (Peiffer Wolf Partner Adam Wolf)

FAQ

Yes. Please call us or use our contact form to request a Free Case Evaluation. We have a national team of attorneys and staff who look forward to speaking with you.

Typically, we represent clients on contingency fee agreements. If we take your case under a contingency fee arrangement, you won’t owe our firm any legal fees unless we are able to recover money for you.

Our contingency fee agreements are usually based on a percentage of the amount we recover for our clients. The contingency fee amount is determined by the type of case, our estimate of how long it will take to resolve your case, and our estimate of the litigation costs we will advance in your case. Each engagement agreement includes the details of the fee arrangement. Questions about our fee agreements are welcomed and encouraged.

In most litigation matters, it is extremely difficult – practically impossible – to predict how long it will take to resolve a particular case. Every case is different, and we will do our best to provide you with an estimate based on your case and our experience with similar cases. Moreover, we will do our best to keep you updated and manage expectations along the way.
